“ONE CHICAGO, ONE NATION” ONLINE FILM CONTEST

OFFICIAL CONTEST RULES


One Nation and Link TV (“the Sponsors”) proudly present the “One Chicago, One Nation: Building America Together” online film contest to help educate people about pluralism and inclusion (the “Film Contest”). These terms, conditions and any notices, including those available by hyperlink (“Official Rules”) or through any websites where these Official Rules appear by hyperlink or otherwise (the “Sites”) will apply to the Film Contest, and to all services provided to you via the Sites. By entering this Film Contest, you agree to all of the Official Rules. This Film Contest is void where prohibited by law. No purchase is necessary to enter or win.

A.    GENERAL FILM CONTEST RULES

  1. Agreement to Rules. All Film Contest entrants (the “Participants”) must strictly comply with the Official Rules.
  2. Eligibility. Except as noted in this section, this Film Contest is open to anyone residing in the United States. Employees, immediate family members of employees, contractors, officers or directors of Link Media, One Nation, Chicago Community Trust, IMAN, Fenton Communications, ThinkInc  Strategy, IFYC, and any other organization directly involved with this project are not eligible.  All Participants under the age of 18 are required to read the Sponsors’ Privacy Policy available at www.linktv.org/privacy.
  3. Submission Terms. All Participants must agree to the “One Chicago, One Nation Online Film Contest” submission terms (“Submissions Terms”) as outlined on Link TV’s webpage at www.linktv.org/onechicago.   All materials, ideas, concepts and communications submitted by Participants (including personal information) will be included in the definition of Submission below.
  4. Submissions. All Participants must submit an audiovisual work (“Submission”) which:
    1. Must include the One Chicago, One Nation end slate at the end of the Submission (find it here or by visiting the Director’s Toolkit).
    2. Must fulfill the category criteria as outlined on Link TV’s webpage at: www.linktv.org/onenation/about.  There will be six categories:  Comedy;  Documentary; Drama; Under 60 Seconds; Animation/Music  Video/Spoken Word; and Mobile Digital Media (which includes videos created on phones, mp3/iPods, Flip cameras) (the “Categories”).
    3. Must be in English
    4. Must be prepared in WMV, AVI, MOV, or MPG file format
    5. Must not exceed 100MB in size; and
    6. Must be either:
      1. 5:00 minutes or less in length (excluding mandatory end-slate) for the Comedy;  Documentary; Drama; Animation/Music  Video/Spoken Word; and Mobile Digital Media Categories ; or
      2. :60 seconds or less for the Under 60-Second Category (excluding mandatory end-slate).
  5. Submissions Are Final. Once submitted, all Submissions are final and may not be altered or edited further. Duplicate Submissions will disqualify all such Submissions.
  6. Submission Deadlines.  Participants may submit Submissions beginning January 14, 2010 at 9:00 a.m. PT through April 23, 2010 at 11:59 p.m. PT.
  7. Content Limitations.
    1. You agree that you will not submit Submissions that are:
    2. Copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to submit the material to this Film Contest in full compliance with these Official Rules;
    3. False, inaccurate, misleading, unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially, ethnically or otherwise offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate, as may be determined by the Sponsors, or contrary to the Sponsors’ other stated policies and procedures, where applicable.
    4. Participants may enter more than one Submission, provided that each Submission is different and submitted in a different Category. Participants may not win two or more Categories.
  8. Disqualification. Submissions which do not comply with these rules in any way may be disqualified, in Link TV’s sole and final discretion, without notice.
  9. Voting Rules. All online voting participants (the “Voters”) must agree to the following voting rules:
    1. All Voters must register as a member of Link TV.
    2. All Voters must be in the United States to vote;
    3. Voters can vote on multiple films and in multiple Categories, (i.e. Voters can vote on more than one film within a Category), but Voters can only vote once per Submission;
    4. If Voters vote more than once per Submission, only their last vote will be counted for that Submission.
    5. Any Voter who violates the above rules may be subject to having all of his/her votes disqualified
  10. Contest Decisions. All decisions regarding the Film Contest will be made by Link TV in its sole discretion and are final.
  11. Miscellaneous. This Film Contest is void where prohibited by law. No purchase is necessary to enter or win.


B.     PRIZES AND JUDGING

  1. Judging Criteria. Submissions will be judged on fulfilling the “One Chicago, One Nation’s” theme of showing the importance of people from different backgrounds working together toward the common good in Chicago and the editorial and technical quality of the submission. Those factors include, without limitations: Does the Submission reflect creativity? Is it imaginative? Does the Submission feel unique and fresh? Has the Participant created a compelling Submission?  Is it accessible?  Is it well-produced?
  2. Voting. The Voters will determine which top five Submissions in each Category advance to the final stage of the Film Contest, with the Sponsors reserving the right to add a sixth finalist in each Category (the “Finalists”).  Online voting will begin as soon as the first Submission is uploaded and accepted and end on Friday April 30, 2010 at 11:59 p.m. PT.
  3. Judging Dates. Link TV will verify the Finalists during the period of May 1, 2010 through May 4, 2010. Judging will take place by a panel of judges no later than the period May 5, 2010 through May 31, 2010 (the “Panel of Judges”).
  4. Early Submission Prizes.  Five Nano iPods will be awarded as early Submission incentive prizes. After 25 entries have been accepted to the Film Contest, the names of five of those Participants will be drawn at random and each will be awarded a Nano iPod.
  5. Prizes.  The Panel of Judges will select one winner from the Finalists of each Category to be awarded $5,000. In addition, an overall Grand Prize winner will be selected and awarded $20,000.
    1. Notification. Winners will be notified in June of 2010.
    2. Releases and Information Requests. All winners must execute final releases and information requests prior to payment of the prizes within two weeks of receiving their winning notification from the Sponsors. Failure to execute final releases or fulfill the information requests or otherwise timely comply with all rules or requests from Link TV will void the award, and the prize may then be awarded to another Finalist.
    3. Taxes. Each winner is responsible for paying any and all taxes on his or her prize(s) and Link TV will report all prizes to the U. S. government as required by law.
    4. Obtaining the Rules. To obtain these rules or for notification of the winners, send a self-addressed stamped envelope to: “One Chicago, One Nation Online Film Contest,” c/o Link TV, P.O. Box 2008, San Francisco, CA 94126-2008. Requests for winner list must be received by May 1, 2010.

 


C.     HOW TO ENTER

  1. The Film Contest Submission Period starts at 9 a.m. PT on January 14, 2010 and ends at 11:59 p.m.  PT on April 23, 2010. Entry is a three-part process; your entry is not final until the following three steps have all been taken and you receive email confirmation of your entry:
    1. First register as a Link TV user.
    2. Then fill out a Submission Form for each Submission.
    3. Upload your Submission. Your Submission must be in the .wmv, .avi, .mov, or .mpg file formats and cannot exceed 100MB.
  2. Once your Submission has been uploaded and approved for viewing, we will send you an email confirmation.
  3. We will alternatively accept Submissions via mail. Participants will still have to register on the Link TV website. Submissions sent via mail must be accompanied by completed Submission Forms and may be sent to: One Chicago, One Nation Online Film Contest, Link TV, P.O. Box 2008, San Francisco, CA 94126-2008.

 


D.     ADDITIONAL CONDITIONS AND TERMS

  1. Ownership/ Rights/ Name and Likeness/Publicity.
    1. By uploading, inputting, providing or otherwise submitting your Submission, you:
      1. warrant to the Sponsors that you have secured all rights and releases to all material in your Submission, including the music, images, scripts, and rights to include all persons, places or organizations included or depicted. If your Submission contains images or identifications of any persons or organizations you agree that, if you are chosen as a Finalist, you will submit release forms from those persons (or their parents or guardians) or organizations for the use of their identification or images in your Submission.
      2. Grant the Sponsors a worldwide, non-exclusive, assignable, sub-licensable, royalty-free, perpetual license to use, reproduce, distribute (through multiple tiers) your Submission in connection with the operation of the Sponsors’ business, including, without limitation, the rights to cache, copy, sell, distribute, transmit publicly display, publicly perform and reproduce your Submission as part of the Sites, and in all other media, telecast, broadcast, via mobile devices, as well as through any other  media and format now known or hereinafter developed.
      3. Agree to allow the Sponsors to use your name, identification, and likeness to use, promote or publicize your video in any matter, without limitation, and without further compensation (except that the name of Tennessee residents who do not so consent will not be used for purely publicity purposes).  You agree to indemnify the Sponsors, its officers, agents, employees and licensees , including for all legal costs, against any challenges to the ownership, use of, or rights in and to your Submission.
      4. Grant all right, title and interest in any physical materials, including the Submission you provide to the Sponsors.
      5. Acknowledge that no Submissions shall be returned.
    2. Except for such obligations explicitly set forth in these Official Rules and in the Submission Terms, the Sponsors shall have all rights to use your Submission in any way, without any further obligation, notice, compensation or approval.
    3. You waive any future claims against the Sponsors or others arising from the use of your Submission.  
    4. Entry in the Film Contest constitutes irrevocable permission for Sponsors and their licensees, and its and their successors, assigns and sub-licensees (collectively, “Licensee”) to use any or all contents of the Submissions and all other materials submitted to Sponsors by Participants and each Participant’s name (except that the name of Tennessee residents who do not so consent will not be used for purely publicity purposes), likeness and biography for use in connection therewith, including for advertising and/or publicity purposes, worldwide and in all media and by all manners (now or hereafter known) and on and in connection with related products, services, advertising and promotional materials, in perpetuity, without further compensation or other consideration.
    5. The Sponsors may use any and all information obtained from Participants for its internal activities, including contacting a Participant.
    6. Participants will continue to own the underlying intellectual property rights in and to their Submission, subject to rights granted to the Sponsors as set forth in these Official Rules and in the Submission Terms.
  2. Harmful Activity. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS FILM CONTEST, INCLUDING THE MANIPULATION OF VOTES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS  RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Any damage made to the Sites will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Any use of robotic, automatic, programmed or like methods of participation will void all such Submissions by the Participant. By entering this Film Contest, you agree that you will not attempt to:
    1. distribute or post spam, chain letters, or pyramid schemes; 
    2. distribute viruses or any other technologies that may harm the interests or property of the Sponsors, their users or the other;
    3. copy, modify, or distribute content from the Sites without the prior written consent of the Sponsors; 
    4. harvest or otherwise collect information about users, including email addresses, without their consent; or
    5. use any robot, spider, scraper or other automated means to access the Sites for any purpose without our express written permission.
  3. Compliance with Laws. You agree to comply with all government laws and regulations. 
  4. Release and Indemnification. As a condition for entry, you agree to release, indemnify and hold the Sponsor (and their successors, parents, subsidiaries, affiliates, officers, directors, agents, joint venturers, employees and attorneys) harmless from any claim, demand, or damage, including reasonable attorney's fees, asserted by any third party due to or arising out of your breach or claimed breach of these Official Rules or the Submission Terms, or your violation or claimed violation of any law or the rights of a third party.
  5. Disclaimer Of Warranties.
    1. The Sponsors are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Sites. The information and services included in or available through the Sites may include inaccuracies or typographical errors. Changes are periodically made to the Sites and to the information therein. The Sponsors and their authorized agents may make improvements and/or changes in the Sites at any time.  The Sponsors and their authorized agents make no representations about the suitability, reliability, availability, timeliness, lack of viruses or other harmful components and accuracy of the information, products, services and related graphics contained within the Sites for any purpose.  All such information, products, services and related graphics are provided "as is" without warranty of any kind.  The Sponsors provide no technical support.
    2. The Sponsors and their authorized agents hereby disclaim all warranties and conditions with regard to the Sites, and all related software, products, services and graphics, including all implied warranties and conditions of merchantability, fitness for a particular purpose, workmanlike effort, title and non-infringement. No oral or written information or advice given by the Sponsors, their agents or employees shall create a warranty or in any way increase the scope of any warranty provided herein. You specifically agree that the Sponsors shall not be responsible for unauthorized access to or alteration of your transmissions of data and for any material or data sent or received or not sent or received.  You agree that the Sponsors are not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights. The Sponsors are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of our websites.
  6. Limitation of Liability. In no event shall the Sponsors, their officers, directors, employees, contractors, affiliates, suppliers, subsidiaries, parent company, agents or lawyers be liable to you or any third party for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data, business or profits, arising out of this Film Contest or in any way connected with:
    1. the use or performance of the Sites;
    2. the delay or inability to use the Sites or related services;
    3. the provision of or failure to provide services; or
    4. any information, products, and related graphics obtained through the Sponsors’ Sites, or otherwise arising out of the use of the Sites, whether based on contract, tort, negligence, strict liability or otherwise, even if the Sponsors or any of our authorized agents have been advised of the possibility of damages, and even if a remedy set forth herein is found to have failed of its essential purpose.
    5. Technical errors of any kind, technical hardware or software failures of any kind, including any injury or damage to any person's computer, related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit your ability to participate in the promotion.
  7. Right to Cancel or Modify.  The Sponsors reserve the right to cancel or modify the Film Contest if fraud, misconduct or technical failures harm the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by the Sponsors, in their sole discretion. In the event of termination, a notice will be posted online and entries will be judged from among all eligible Submissions received prior to termination. If insufficient entries are received, or if no entry submitted meets minimum reasonable criteria for a prize, in the Sponsors’ sole and final discretion, fewer than all awards may be made. 
  8. Proof of Submission. Proof of submitting entries or responses to inquiries will not be deemed to be proof of receipt by the Sponsors. Only receipt of an e-mail from the Sponsors acknowledging an entry or communication will be considered proof of submission.
  9. Right to Exclude. The Sponsors reserve the right to prohibit the participation of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.    
  10. Article and Section Titles.  The headings herein are inserted as a matter of convenience only and do not define, limit, or describe the scope of this Agreement or the intent of the provisions hereof.
  11. Separability of Provisions.  Each provision of this Agreement shall be considered separable; and if, for any reason, any provision or provisions herein are determined to be invalid and contrary to any existing or future law, such invalidity shall not impair the operation of or affect those portions of these Official Rules which are valid.
  12. Choice of Law. This Film Contest is offered only in the United States and is governed by the laws of the State of California. All claims relating in any manner to this Film Contest or to any Submission must be resolved in the federal or state courts of California. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Participants and the Sponsors in connection with the Film Contest, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California). Any claim or cause of action arising out of or related to this Film Contest, the Sites, or these Official Rules must be filed within one (1) year after such claim or cause of action arose regardless of any status or law to the contrary. In the event any such claim or cause of action is not filed within such one (1) year period, such claim or cause of action shall be barred.
